Just days after Pennsylvania Representative John D. Payne introduced legislation to allow online gambling within the state, a second online gambling bill has been introduced. Pennsylvania Representative Nick Miccarelli introduced HB 695 which focuses only on online poker within the state. Miccarelii is not new to introducing online poker bills as he did so in 2014 with bill HB 2297 but this bill did not move forward into legislation.
With the new bill, it has been reported that the language is similar to last year’s bill and would focus on online poker. Bad actor clauses are said to be included in this bill and would stop PokerStars from entering into a regulated market within the state.
According to a report by PokerSites, the bill introduced last year stated that Pennsylvania should not provide licensing to companies or companies using assets of any company that ignored federal or state law once the Unlawful Internet Gambling Enforcement Act was created in 2006. The bill also proposed that those companies that have existing licenses within the state should retain supervisory and operational control over the new vendors, with vendors being blocked from operating under their brand.
Basically the bill reads that to maintain the control and supervision is in the hands of the licensed company, any website or portal must be promoted and made available to consumers under the licensed entity’s name and brand, rather than the brand of the third party provider.
Along with the new bill by Miccarelli, the Payne bill still remains. When the bill by Payne was first introduced, many were confused as to what it exactly covered based on the language used. It has now been made clear that the bill covers both online poker and online casino game with the language revision. At first, the bill appeared to be focused solely on poker but has since been corrected.
