Just a few days ago, we brought you the story of a group of gamblers who won $1.5 million at the mini baccarat tables at the Golden Nugget tables. The group of fourteen gamblers won the money due to a fluke at the casino, the cards had been unshuffled, and this caused the players to be able to continue raising their wagers and winning major cash.
Several officials at the casino, including floor managers, supervisors and others felt as though the players had cheated. Even going so far as to restrain a player in a hotel room without food and wager as they interrogated.
The casino eventually found out that the cards they had just ordered had not been shuffled. The casino then proceeded to sue the card company, Gemaco, and the players. The players cashed out almost $559,000 back in April but they did not immediately cash out the remaining $977,800. The casino wanted to see the money returned and they felt they do not owe the remaining cash to the players.
However, the gamblers lawyer disagreed and stated: “The Golden Nugget appealed to gamblers to come in and play games licensed and sanctioned by the state of New Jersey. My clients did exactly that, and then were denied their winnings. There is absolutely no law in New Jersey that would permit the Golden Nugget to declare the game illegal because it failed to provide shuffled cards.”
Three of the fourteen players decided to counter sue the casino citing that they were discriminated against because they were of Asian descent. Then on September 1st, the case was seen in court and Judge James Isman decided to side with the players. The Judge stated: “There is no clear and convincing, real evidence that there were unlawful actions. I don’t consider this to be a rigged game. There is no proof that the players obtained those chips unlawfully.”
The judge went on to state that the players did take advantage of the noticeable pattern during the game but they did not know that the pattern would continue so they were still gambling. If the pattern had eventually ended, the players would have lost.
The lawyers of the Golden Nugget were going to appeal the ruling but Tilman Fertitta, the owner of the casino, stated that enough is enough. Fertitta stated: “even though we can appeal the court’s ruling and take full advantage of the appellate process and legal system, and tie the matter up in litigation for a number of years, the Golden Nugget is a people business, and is prepared to allow the gamblers—most of whom continue to gambler at Golden Nugget—to realize the gambler’s dream of beating the house.”
However, Fertitta has placed a stipulation on the remaining funds. Both sides will have to agree to drop all of the lawsuits for the players to get the remaining money. it is yet to be seen if the players will agree to this stipulation.
