The long-standing legal battle between poker pro Phil Ivey and the Borgata Casino of Atlantic City continues as the casino has now filed a motion to see the counter-claims filed by Ivey dismissed from the court. Ivey filed a counter-claim back in August and now the Borgata has filed a motion to see the claim thrown out. The next time the matter will be heard in court will be on the 2nd of November.
Ivey and co-defendant Cheung Yin Sin have been the subject of news reports for many months now after being accused of counting cards illegally by using edge-sorting methods during game play at the Borgata. In the filing back in August by Ivey, he states that that casino tried to influence his game play at the table in a negative manner by using attractive waitresses and free alcohol.
While filing the claim, Ivey was quoted as stating that everyone knows when you drink alcohol, it impairs your judgement and the casino offers that. Ivey stated the waitresses continued to talk to him while playing baccarat and he even got a few numbers.
The Borgata is refuting the claims of the new submission, asking the court to narrow the scope of the case to consider only the legality or illegal nature of edge sorting. According to the Borgata, the issues has always been and remains about edge sorting. The casino contends that Ivey and Sun admitted to the practice so it should be determined if this method is cheating or unfair play. The Borgata states that the individual playing cards, complimentary drinks or cocktail servers do not change the answer to this question.
Ivey does not believe that edge sorting is illegal while the Borgata feels the action is against state law. The response by Ivey sheds light on another side of the gambling industry, stating that the additional options provided for entertainment to guests, such as drinks and promotional staff, while enticing to everyday gamblers is unsettling to professionals who gamble as a career.
