Back in January, the Attorney General Nominee Loretta Lynch was badgered by Senator Lindsey Graham on her views of the of the 1961 Wire Act and the Department of Justice 2011 ruling which has allowed such states as Delaware, Nevada and New Jersey enter into the US online gambling industry. Lynch was under fire but kept her cool, stating she was familiar with the subject and agreed to answer questions on the matter in writing. The AG nominee is now being spoken of by Nevada Senator Dean Heller, who reportedly will not be voting for her to hold the position as Attorney General.
Heller spoke with Politico in regards to Lynch and stated that he was not satisfied with her answers on the subject of the 1961 Wire Act. He was more unsatisfied that Lynch was not willing to overturn the 2011 Office of Legal Counsel opinion that limits the Wire Act to sports betting.
In the report, Heller stated that he is leaning towards voting no at this point, not a definite no but most likely. The senator continued by stating he was concerned by the answers of Lynch on the Wire Act, stating she knew very little of what occurred but prosecuted illegal gambling and offshore gambling. Heller believes you cannot prosecute illegal gambling and say you have little knowledge of the Wire Act.
Heller seems to have a skewed view as to what Lynch actually said on the Wire Act. The written responses that were sent to Senator Lindsey Graham, who fired off question after question on the subject during a meeting, were knowledgeable and showed an understanding of the 2011 changes to the Wire Act.
During questioning by Graham, Lynch stated she did not want to comment in detail without researched the content further and promised to review the Wire Act in full. She obviously did not give Graham or Heller the answers they wanted to hear so they are in opposition to her taking on the Attorney General position.
