The end of the year is upon us and while most thought California might have some sort of legislation on the books for online poker gaming that is not the case. However, one State Senator is not giving up and has made changes to his online poker bill in the hopes that it will pass before 2014 is complete.
State Senator Lou Correa is the author of Senate Bill 678 which is titled the Authorization and Regulation of Internet Poker and Consumer Protection Act of 2013. Correa is currently making changes to the bill in the hopes that it will be made law over the next few weeks.
The Senator amended the bill to create an urgency statute which would made it have the need to be approved by two-thirds of each house of the state legislature. If this happens, the bill would take immediate effect once it is signed into law by the State Governor. Before the amendment was made, the bill had to have the majority vote to be able to pass and then would not have been immediately effective after being signed by the Governor.
Correa states in the bill that it is important to move to urgency statute so that the interests of Californians who play online poker games are protected and players are able to play fair games as well as for the state to realize the revenues and that suitable persons operate intrastate Internet poker games. Basically, Correa wants the option in California to go live as players are at risk by taking part in unregulated gaming and the state would be able to benefit from the revenues created.
The bill was also amended to be ‘severable’ according to the report and in Article 10, Section 2, Correa writes that the provisions of the act are severable and if any provision of the act or application is held invalid, that invalidity shall not affect other provisions or applications that can be given effect without the invalid provision or application. This means that the bill can move forward if one part of the bill is found to be invalid.
