A class action suit served by Kelly Sonnenberg towards the Rational Group has now been dismissed, according to a recent report by Pokerfuse. Just last week a District Court judge dismissed the case against PokerStars parent company, which was filed on behalf of Illinois poker players. The plaintiff claimed they were owed money due to illegal gambling.
Ifrah Law is the law firm representing Rational Group and the firm noted that the dismissal of the case should be the end of the class action suit. Judge David R. Herndon ruled in favor of the online poker company and Jeff Ifrah, the founder of the Ifrah Law firm stated that the ruling was a major victory for the online poker room.
Ifrah further stated that the ruling is instructive for providers of online gaming who may face similar incidents of attack. The purpose of the class action filing was to recover losses due to gambling by customers of PokerStars who were located in the state of Illinois. According to the law of the state, third parties can try to reclaim money from the winner, that was lost, if illegal gambling was taking place.
Sonnenberg stated to be a parent of a player that lost funds online at the poker site. The court ruled that PokerStars was not viewed as the ‘winner’ but more like a third party provider of a service that offers an outlet for the game to take place. The judge further ruled that PokerStars did not have a stake in how the game is determined. The ruling stated that the plaintiff did not define exactly what was lost in the case.
Under the Loss Recovery Act of the state, an award of triple the amount lost while illegal gambling can be recovered from the winner. If the suit had not been dismissed, PokerStars and The Rational Group may have lost hundreds of millions of dollars as a result.
